Terms of Service
Effective July 27, 2026
1. Agreement to Terms
These Terms of Service ("Terms") are a binding contract between you ("you" or "User") and SureShield Quotes, LLC ("SureShield," "we," "us," or "our") governing your access to and use of our website, lead-capture forms, APIs, data feeds, and any related services (collectively, the "Services"). By accessing the Services or submitting a form, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
2. Indemnification
You agree to defend, indemnify, and hold harmless SureShield, its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your submission of inaccurate or unauthorized consumer data.
3. Binding Arbitration & Class Action Waiver
You and SureShield agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the privacy or security of your information — whether based in contract, tort, statute, fraud, or any other legal theory — shall be resolved exclusively through individual binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters related to intellectual property, confidentiality, or a violation of Section 4.
Class action waiver. You agree that any arbitration or court proceeding shall be conducted only on an individual basis and not as a class action, consolidated action, representative action, or private attorney general action. You expressly waive any right to participate in class actions, class-wide arbitrations, or any other representative proceeding against SureShield.
Opt-out. You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending a written notice to support@sureshieldquote.com with your name, address, and a clear statement that you do not wish to resolve disputes with SureShield through arbitration.
4. Clickwrap Agreement & Acceptance
These Terms are presented through a clickwrap agreement. Before submitting any form or otherwise using the Services, you must click or tap an affirmative action (such as "I agree to the Terms of Service" or a submit button accompanied by a clear statement of acceptance) indicating that you have read, understood, and agree to be bound by these Terms.
By clicking "Submit" or any other submission button on the Services, you expressly acknowledge that (i) you are entering into a binding contract with SureShield, (ii) you have had the opportunity to review these Terms, and (iii) you agree to all provisions, including the anti-scraping restrictions, the liquidated-damages clause in Section 8, the indemnification clause in Section 2, and the arbitration and class-action waiver in Section 3. If you do not agree, do not submit any form or use the Services.
5. Ownership of the Platform, Data, and User Flow
The Services — including our website layout, page structure, form fields and their ordering, quote-capture logic, code-verified call handshake, consent language, workflow diagrams, brand assets, copy, database schemas, lead records, and the full user journey from ad click through policy sale (collectively, the "SureShield IP") — are the exclusive property of SureShield Quotes, LLC and are protected by copyright, trademark, trade secret, and contract law. No rights are granted to you except the limited, revocable license expressly described in Section 6.
6. Limited License
Subject to your continued compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Services for their intended purpose — requesting insurance quotes and related consumer interactions. All other uses are expressly prohibited.
7. Prohibited Conduct — Scraping, Copying, and Duplication
You expressly agree that you will not, and will not permit or enable any third party (including any employee, contractor, affiliate, agent, vendor, or competitor) to, do any of the following without our prior written consent:
- No scraping or automated access. Use any robot, spider, crawler, scraper, headless browser, automated script, data-mining tool, AI agent, or similar means to access, index, harvest, mirror, or extract any portion of the Services, lead data, form submissions, pricing, or content.
- No duplication of layout or UI. Copy, replicate, reproduce, or create derivative works of our website layout, page structure, visual design, component arrangement, color system, or brand presentation.
- No copying of the user flow. Replicate, imitate, or reverse-engineer our lead-capture flow, quote form field sequence, code handshake protocol, immediate code display and email confirmation, consent capture methodology, agent routing logic, or any other workflow that constitutes the SureShield journey.
- No reverse engineering. Decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Services.
- No circumvention. Bypass, disable, or interfere with any bot-protection, rate-limit, honeypot, CAPTCHA, verification, or security feature of the Services.
8. Contractual Enforcement — Breach of Contract
You acknowledge and agree that Section 7 constitutes a material and bargained-for term of these Terms. Any violation is an independent breach of contract, enforceable regardless of whether the conduct also violates copyright, trademark, trade secret, computer-fraud, or other applicable law. In other words: even if a court finds that the copied element is not itself protectable by intellectual-property law, you have still breached this contract by copying it, and SureShield may sue for that breach.
You further acknowledge that any breach of Section 7 will cause SureShield irreparable harm for which monetary damages alone are inadequate, and you consent to the entry of injunctive and other equitable relief without the need to post bond, in addition to any monetary damages, disgorgement of profits, and recovery of SureShield's reasonable attorneys' fees and costs.
Liquidated damages. Because actual damages from unauthorized scraping, duplication of our layout, or copying of our user flow are inherently difficult to quantify, you agree that a reasonable estimate of such damages is $25,000 per incident, plus $10 per lead record accessed, copied, or exported without authorization. These liquidated damages are not a penalty and do not limit any other remedy available to SureShield.
9. Consumer Data and Privacy
Consumer data submitted through the Services is collected, stored, and handled pursuant to the consumer's TCPA-compliant consent and our Privacy Policy. Consumer data will not be used for any purpose other than the one for which consent was given.
10. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, SureShield's aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amounts you paid to SureShield in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100). Nothing in this Section limits SureShield's right to recover damages, liquidated damages, injunctive relief, or fees under Section 8.
11. Governing Law, Venue, and Attorneys' Fees
These Terms are governed by the laws of the State of Texas, Louisiana, Oklahoma, or Arkansas — the state in which SureShield Quotes, LLC is organized or principally operated — without regard to conflict-of-laws principles. Exclusive venue for any dispute arising out of or relating to these Terms shall lie in the state or federal courts located in that state, and you consent to personal jurisdiction there. The prevailing party in any action to enforce these Terms is entitled to recover its reasonable attorneys' fees and costs.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after an update constitutes acceptance of the revised Terms. Material changes will be indicated by updating the "Effective" date at the top of this page.
13. Contact
Questions about these Terms, or requests for written authorization to do anything otherwise prohibited by Section 7, should be directed to support@sureshieldquote.com.
